FARC and Colombian Government Agree to Truth Commission, Recognition of Victims

With the Colombia run-off election 8 days away, FARC and the Government of Colombia reached another milestone in the Havana peace talks.

Both sides agree the victims of the violence in Colombia must be heard. A truth commission will be set up, which FARC refers to as the "Commission of Clarification of the Origen and the Truth of the History of the Conflict." FARC has also declared a cease-fire for the next three weeks, through the election.

Here is the text of the agreement (English). Here is FARC's press release (English.)

Colombia Reports uses the headline "FARC formally admits responsibility for victims of Colombia conflict" but I think that's misleading. FARC has not admitted responsibility for the atrocities to the victims. In fact, the agreement says at this stage, the parties will not be exchanging blame. Recognizing there are victims and that the victims have a right to be heard and learn the truth is not the same as an admission of guilt or responsibility for what befell them. FARC and the Government have always claimed the other is responsible. The agreement says: [More...]

Hershey Sues Edible Company Over Look-a-like Candies

Hershey Chocolates has filed a federal trademark infringement lawsuit against TinctureBelle LLC and TinctureBelle Marijuanka LLC, a Colorado company that makes marijuana-infused candy.

Hershey claims the packaging for the edibles too closely mimics its trademarked products. It also objects to TinctureBelle's online advertising. The complaint (Case No. 14-cv-01564-WYD, District of Colorado) includes photos of the alleged infringing products. [More...]

Here's an open thread, all topics welcome.

DEA Threatens MA Medical Marijuana Doctors

Massachusetts enacted a medical marijuana law in 2012. Recently, shortly after the first licenses were approved, the DEA began visiting MA physicians associated with medical marijuana dispensaries and giving them a choice: Give up your DEA license to prescribe most medications, or give up your association with dispensaries.

The stark choice is necessary, the doctors said they were told, because of friction between federal law, which bans any use of marijuana, and state law, which voters changed in 2012 to allow medical use of the drug.

The DEA’s action has left some doctors, whose livelihoods depend on being able to offer patients pain medications and other drugs, with little option but to resign from the marijuana companies, where some held prominent positions.

The DEA gets progressively more out of step with the Department of Justice, Congress and state legislatures every day. Its budget is bloated and it desperately needs new leadership. DEA Director Michelle Leonhart, who presumably approves tactics such as these, should be asked to resign and a more enlightened director should be appointed to take her place. You can sign a Change.Org petition to remove her here.

Maureen Dowd's Eating Disability

New York Times columnist Maureen Dowd came to Colorado and wanted to try the state's newly legal pot. Rather than smoking a joint, she decided to try a pot-infused candy bar. She says she nibbled the end of the bar and not feeling the high, nibbled a bit more. She ended up gob-smacked by her piece of candy -- it laid her out for 8 hours and made her delusional and paranoid. She blames her experience on labeling deficiencies on the candy and criticizes Colorado's regulatory system.

Why would an intelligent adult like Dowd, who is obviously not a regular marijuana user, not inquire about potency or dosage before she experimented? When she first felt the effects, why didn't she turn on her computer and do a google search -- she would have quickly learned she should drink a lot of water and "this too, shall pass."

Instead of accepting personal accountability for her actions, she blames the candy, the manufacturer and retailer's lack of warning labels, Colorado's regulatory system -- everyone but herself. Her column reeks of a "reefer-madness" mentality. Her tale includes references to a man jumping off a roof, a man who kills his wife and stoned driving. [More...]

George Jung ("Blow") Released After 20 Years

Legendary cocaine trafficker George Jung (played by Johnny Depp in the movie "Blow") has been released from prison to a halfway house after serving almost 20 years behind bars.

Jung says on his website:

Jung was a part of the Medellin Cartel which was responsible for up to 85 percent of the cocaine smuggled into the United States. He specialized in the smuggling of cocaine from Colombia on a large scale.

Jung was first sent to the federal prison in Danbury on a marijuana case. While there, he made friends with Carlos Lehder, who along with Pablo Escobar, the Ochoa brothers and Jose Gonzalo Rodriguez Gacha (alias El Mexicano) headed up the Medellin cartel. In the movie, Jung says:

Danbury wasn't a prison, it was a crime school. I went in with a Bachelor of marijuana, came out with a Doctorate of cocaine.

Fla. Judge Who Smacked Public Defender Given Leave of Absence

Florida Judge John Murphy got angry when a public defender refused to waive speedy trial. He told the defender if he wanted to fight, to go into the hallway and he'd beat his as*. The public defender didn't think he meant he'd physically beat him, and went into the hallway to continue the verbal dispute. The judge smacked him. The camera doesn't catch the hallway brawl, but you can hear it.

Judge Murphy has been relieved of his duties and will undergo anger management. The public defender's office will file a bar complaint against the judge.

The public defender who got whooped has declined to press charges. [More...]
