    Brett Kavanaugh's surprise ruling in racial justice case astonishes expert

    Writing for the 5-4 majority, Kavanaugh found this wasn't allowed because the judge skipped over the third step of Batson and denied Pitchford a chance to challenge the prosecutors' race-neutral rationales as pretextual. This, Millhiser pointed out, is exactly the process Kavanaugh highlighted the importance of in a note he wrote in law school, titled "Defense Presence and Participation: A Procedural Minimum for Batson v. Kentucky Hearings."

    Four conservative justices, led by Neil Gorsuch, dissented, Millhiser said, arguing "that Pitchford waived his Batson argument because, while his lawyers raised it in the trial court, they did not provide enough detail about how, specifically, the trial judge violated Batson when they raised this objection." Lawyers generally can't introduce new arguments on appeal -- but this is irrelevant, "because, as Kavanaugh explains, defense counsel raised their Batson argument multiple times at trial."

    Jazz legend Sonny Rollins has passed away.

     Rollins was the last survivor of the 57 jazz musicians depicted in the 1958 photograph A Great Day in Harlem.

    A Drag Show that has had the local white nationalist in a tizzy.  They tried to stop it.  They organized a bunch of local churches to "pray for it to fail".  They demonstrated with silly signs on the sidewalk in front.  

    It did t work.  It was sold out. It was a huge success. Everyone had a great time and Hardy may never be the same.

    President Donald Trump in a social media post on Tuesday disputed that Iran has cut off communication with mediators, calling Iranian reports of a cessation in talks "false and erroneous," the AP reports.

    Said Trump: "The conversations between us have been going on continuously, including four days ago, three days ago, two days ago, one day ago, and today. Where they lead, one never knows, but as I told Iran, `It's time, one way or another, for you to make a Deal. You've been doing this for 47 years, and it cannot be allowed to go on any longer!'"

    I mean, everyone knows he is lying.  Everyone knows Iran is more believable than Trump.

    ... was fired last night by CBS News following his rather explosive confrontation that show's new executive producer Nick Billton on Monday morning - which was recorded on audio - during his introductory meeting with what was left of the show's staff after CBS News dilettante-in-chief Bari Weiss's vindictive purge of key personnel last week.

    No doubt, Pelley - who had also served as a former anchor for the CBS Evening News - likely expected that this would be the outcome when he stood up for his just-axed colleagues and said out loud what everyone was thinking about the incompetent and thin-skinned Ms. Weiss.

    So, rather than watch 60 Minutes die a quiet death by a thousand cuts, Pelley bluntly called the question and compelled Weiss to do publicly what she had been hoping to do quietly. He fell on his sword in the most public and messy way possible. He got a standing ovation by his colleagues after Billton left the room, and he received an unceremonious letter of termination the following evening.

    While 60 Minutes will probably continue to air next season, at least for the time being, this is for all practical purposes the end of that Sunday on-air newsmagazine as we've come to know it over the last 50-plus years.

    For over 80 years, CBS News set the institutional benchmark for excellence in broadcast journalism. By running that venerable news division like she's a 5-year-old playing with her Barbie's Dreamhouse, the MAGA-friendly Ms. Weiss has needed only eight months to not only completely trash its once-stellar reputation, but to also abuse the trust of its long-loyal audience, many of whom have noticed the changes and have started reaching for the remote.

    Audience numbers for the CBS Evening News have already declined by nearly 30% since Bari Weiss's arrival. I now expect the same to happen with 60 Minutes. At that point, Paramount Skydance CEO David Ellison may well decide that Weiss has served her useful purpose in doing Donald Trump's bidding for him, and he'll toss her aside with a lucrative golden parachute.

    But the destructive damage inflicted upon the heretofore well-respected CBS News is going to be longstanding if not altogether permanent, and that bloodstained kneecapping will forever be Ms. Weiss's legacy in the annals of American journalism.

    They say you can't time the market. But I sort of have a plan to move out of equities later this year. I have already liquidated any bond funds that I owned that were tied to US Treasuries. I sincerely believe the phrase "full faith and credit of the United States government" is going to become a punch line come 2027. I have moved to foreign bond funds and short term corporate bond funds.

    I depend on stock dividends to pay my bills. SS doesn't cover my monthly nut. If the market crashes, I will have to start depleting cash to pay the bills.

    I copied this from the Wikipedia article on "Death to America":
    Travel writer Rick Steves recorded a taxi driver in Tehran exclaiming "Death to traffic!" in English, explaining that "when something frustrates us and we have no control over it, this is what we say". Steves compares the phrase to non-literal use of the word damn in American English.

    So perhaps the claim that these slogans show murderous intentions towards the people of America and Israel is an exaggeration.

    A new Public Policy Polling survey in Texas finds James Talarico (D) leading Ken Paxton (R) in the U.S. Senate race, 45% to 38%.

    And in a midterm election year in which the GOP is defending 22 seats, a Texas that's actually in play could be incredibly significant to Democratic fortunes.

    For voters to fully comprehend just how far Republicans have fallen, and just how morally hollow and ethically corrupt they've become, they need only look at the Texas attorney general, whose career reads like a mafioso rap sheet.

    Democrats need to make Ken Paxton the poster child for who the Republicans have become.

    An old, but apt fable:

    A scorpion wants to cross a river but cannot swim, so it asks a frog to carry it across. The frog hesitates, afraid that the scorpion might sting it, but the scorpion promises not to, pointing out that it would drown if it killed the frog in the middle of the river. The frog considers this argument sensible and agrees to transport the scorpion. Midway across the river, the scorpion stings the frog anyway, dooming them both.     One of President Donald Trump's biographers shared a sobering prediction about how the second Trump administration will end during a new podcast interview on Tuesday.

    "I think that there's a very good chance that it just ends all of a sudden," Wolff said. "No warning, no preparation. He falls."

    Wolff added that if the second Trump administration were to end abruptly, that may be all Trump needs to be remembered by the history books.

    ... pretty decent people who are generally pleasant to be around. I've long admired their strong sense of community, which prompts them to rally around those who suffer misfortune and freely give of themselves without any sense of expectation.

    When my late sister - who was a Catholic married to a Mormon in Utah - fell ill with leukemia, they proved to be an invaluable support system for her family. I remember one time when my wife and I flew into Salt Lake City to see her and to my surprise, we were greeted at the airport by their neighbor, who offered to pick us up because my brother-in-law was at the hospital. It was just a nice thing to do.

    That said, the organizational agenda, groupthink and mindset of the Latter-Day Saints very much concerns me. It's as though this collective of very nice people becomes the socio-economic equivalent of a waxy yellow build-up that is impervious to diverse opinions and outside influence. And that tends to be distinctly unhealthy and intolerant.

Talarico seems to do well with Hispanics and if Kamala had had Hillarys Hispanic numbers she would have carried Texas.     I agree on trying anything to stay in power.  I previously thought the miltary wouldn't go along with a coup but with the responsible officers fired or sidelined and that rally he had down the road at Ft. Bragg I am mo longer sure about that.
