Gov't Appeals Tounisi Bail Order, Bail Order Revoked

Yesterday, 18 year old Abdella Tounisi, the latest terror sting victim of the FBI, was ordered released on bail by a U.S. Magistrate Court Judge. The Government immediately appealed to the District Court Judge who today reversed the Magistrate Court Judge. Tounisi will remain in custody.

Thursday Night Open Thread

For the last few days, I've been following the twitter feeds of the friends of Dzokhar Tsarnaev who insist he is innocent and has been framed and rebuttal articles by conservative bloggers who think they are full of it. I hope to have a post up about this tomorrow.

More Unauthorized Leaks of Tsarnaev Post-Arrest Statements

All it takes is for one or two unnamed federal law enforcement officials to make an unsubstantiated claim and every media outlet runs with it as if it is true. The latest: Claims that Dzhokhar Tsnarnev told the FBI the bombs for Boston were made in the apartment Tamerlan Tsarnaev shared with his wife and that the brothers initially planned on bombing Boston on the 4th of July but it was so easy to build the bombs they moved up their timetable

The bombs used in the Boston Marathon attack were built in the apartment that suspect Tamerlan Tsarnaev shared with his wife and child, a U.S. law enforcement official with first-hand knowledge of the investigation told CNN on Thursday. The official was not authorized to release the information.

....Tsarnaev and his younger brother, Dzhokhar, initially planned to carry out an attack on July 4, but their bombs were ready earlier than they expected and they decided to move up the date, a U.S. law enforcement official told CNN on Thursday.

Lynne Stewart May Get Early Release Due to Cancer

New York civil rights attorney Lynne Stewart has the backing of medical authorities at BOP Federal Medical Center Carswell to be released from her 10 year terrorism-related sentence due to advanced cancer. Her request will now go to the BOP and federal court, hopefully for approval.

You can read her press release here. Stewart has been battling cancer since 2006.

Stewart's conviction stretched the definition of material support to a terrorist organization to new limits. Here's a transcript of an interview she and her trial lawyer Michael Tigar gave after the jury found her guilty.

Dzhokhar Tsarnaev's Friends Charged With Obstruction, False Statements

Here is the Complaint filed today against three of Dzhokar Tsarnaev's friends, Dias Kadyrbayev, Azamat Tazhayakov and Robel Phillipos. The complaint alleges Dias and Azamat went to Dzhokar's dorm room and retrieved his laptop and a backpack with explosives, which Dias later threw away. They are charged with obstruction of justice. Memoirs of Guantanamo Detainee Mohamedou Ould Slahi

Slate has obtained extraordinary compelling memoirs of Guantanamo detainee Mohamedou Ould Slahi and is publishing them in three parts. Here is Part 1.

Slahi, a Mauritanian, has been in custody since 2001. He is still at Guantanamo. Here's a timeline of his captivity. He finished his handwritten 466 page memoir in 2006, but it took 6 years for the Pentagon to declassify it. Here's a 9 page sample of his handwritten version.

He describes what he calls an "endless world tour” of detention and interrogation." He was taken from Mauritania to Jordan to Bagram to Gitmo -- his account is riveting. [More...]

Tuesday Open Thread

There was a hearing in the George Zimmerman case today. Zimmerman and his lawyers confirmed they are not seeking to have the case dismissed prior to trial based on immunity. However, Mark O'Mara said the defense may still raise immunity at trial, after all the evidence is in. More here.

Obama to Congress: Close Guantanamo

President Obama gave a news conference today at which he renewed a request to close Guantanamo:

"I continue to believe we have to close Guantanamo. I think it is critical for us to understand that Guantanamo is not necessary to keep America safe.

"It is expensive. It is inefficient. It hurts us in terms of our international standing. It lessens cooperation with our allies on counterterrorism efforts. It is a recruiting tool for extremists...."It needs to be closed," he said.

More than 100 of the 168 detainees are now on a hunger strike.[More...]

Judy Clarke Appointed to Represent Dzhokhar Tsarnaev

Dzhokhar Tsarnaev just got the biggest gift of his life -- Judy Clarke has been appointed by the court to represent him along with the Federal Defenders.

Among the lives Judy has helped save: Jared Loughner, Eric Rudolph, Susan Smith, and Ted Kaczinski.

I wrote a week ago that her phone must be ringing off the hook, and I'm so glad she accepted the appointment. There is no one more suited for the task and more capable. More on Judy here and here.

Tsarnaev has become the new poster child for "the worst of the worst." If anyone can gain his trust to be able to provide him an effective defense and save his life, it's Judy.

Judy rarely talks to the media but last week, she was the keynote speaker at a Loyola Law School conference, and spoke a little bit about being a death defense lawyer.

R.I.P. Barry Fey

Long-time Colorado concert promoter Barry Fey has died. He was a local legend. From Ebbets Field to Mile High Stadium to Red Rocks, Barry Fey defined Colorado concerts. No one came close to matching his three decades of bringing the biggest groups to Denver. He was also quite a colorful character.

The past few years weren't great for him, health-wise or financially. He was recovering from a difficult hip replacement surgery last month. Sources say he took his own life.

Hunter Thompson also couldn't get past difficult hip replacement surgery. In his last note, written to his wife Anita four days before he took his own life, he wrote:

"No More Games. No More Bombs. No More Walking. No More Fun. No More Swimming. 67. That is 17 years past 50. 17 more than I needed or wanted. Boring. I am always bitchy. No Fun — for anybody. 67. You are getting Greedy. Act your old age. Relax — This won't hurt."

R.I.P. Barry Fey. Your legacy in Denver lives on.

"Misha" Surfaces, Denies He "Radicalized" Tamerlan Tsarnaev

Misha has come forward. He is Mikhail Allakhverdov, 39 years old and lives in Rhode Island. Christian Caryl interviewed him and his family today.

He confirmed he was a convert to Islam and that he had known Tamerlan Tsarnaev, but he flatly denied any part in the bombings. “I wasn’t his teacher. If I had been his teacher, I would have made sure he never did anything like this,” Allakhverdov said.

Misha says he's cooperated with the FBI and they are going to close the case on him. He also said he's never met the Tsarnaev relatives accusing him of radicalized Tamerlan. [More....]
