Scooter Libby Disbarred

I. Lewis "Scooter" Libby was disbarred today. The court said he perjury conviction was a crime of moral turpitude.

The former White House aide was found guilty a year ago of obstruction of justice and lying. Those are considered crimes involving "moral turpitude" that under the law require disbarment, the District of Columbia Court of Appeals ruled.

The court had previously suspended Libby from the practice of law in Washington. President George W. Bush in July commuted Libby's 2-1/2-year prison sentence, enraging Democrats who accused Bush of abusing his power.

Libby did not challenge the disbarment.

    who whined that Fitzgerald somehow "owed" the press and pundits a juicy leak on the indictments(Libby)?

    I wish I could remember.  I think Glenn Greenwald gave it his usual detailed analysis.

    I'm glad Fitzgerald is a public servant.

    Squeaky: I disagree.  The disbarment was automatic, based on the conviction.  The presidential commutation of the sentence left the conviction intact; hence, disbarment.  A "full and absolute" pardon -- the normal kind -- would remove the predicate for the disbarment in this case.

    The President has the power to give criminal pardons, but he does not have the power to to reverse an administrative decision of the D.C. Bar. The DC Court of Appeals has specifically held that the granting of a Presidential pardon does not nullify the Bar's authority to impose professional discipline based on the underlying conduct. In re Abrams 689 A.2d 6 (1997). That case was about Elliott Abrams, one of the Republican criminals from Iran-Contra).

    Also, even if Libby is pardoned (a good reason to impeach GWB on January 19) Libby will not be automatically subject to reinstatement. Reinstatement is based on a showing of contrition, rehabilitation, and a showing of present good moral character.

    Bill Clinton was also disbarred because of perjury, and he's going to be our copresident.
