I have only heard rumors about Obama's secure smartphone. Just assumed if the O had one, of course his SOS had one. This changes everything. Her staff had few options for secure quick communication, and that is a must have for the Secretary of State for the United States!!!! If any security risk existed, the onus for me now rests entirely on the NSA.

And someone needs to prove to me the denial of the secure smartphone wasn't politically motivated. Who specifically at the NSA denied her this and made "the cost" claim? This information if true places individuals in the NSA in an incredibly suspicious place.

With all things Clinton, nobody ever really needs to "prove" anything. For yet another example of the media's invocation of the "Clinton Rules," check out David Sanger's article in yesterday's New York Times:

"When the F.B.I. director, James B. Comey, said on Tuesday that his investigators had no 'direct evidence' that Hillary Clinton's email account had been 'successfully hacked,' both private experts and federal investigators immediately understood his meaning: It very likely had been breached, but the intruders were far too skilled to leave evidence of their work." (Emphasis is mine.)

Having now established that the 4th Estate don't need no stinkin' badges when pursuing the Clintons, Sanger lets us know that if Elmer Fudd hadn't stopped to take a leak, he'd have undoubtedly caught that wascally wabbit:

"'Reading between the lines and following Comey's logic, it does sound as if the F.B.I. believes a compromise of Clinton's email is more likely than not,' said Adam Segal, the author of 'Hacked World Order,' who studies cyberissues at the Council on Foreign Relations. 'Sophisticated attackers would have known of the existence of the account, would have targeted it and would not have been seen.'" (Again, emphasis is mine.)

Now, there's no actual proof to back any of this up, of course -- but that doesn't stop Sanger and his interview subjects from engaging in the sort of free-range speculation that's probably de rigueur amongst the chattering class at happy hour:

"Since the disclosure that Mrs. Clinton used private email, government officials and many outside the government have been monitoring cyberspace, looking to see if any of her messages, or those directed to her, made their way into the public domain. Documents from the Democratic National Committee began circulating after it announced a breach that also appears to have been conducted by Russian intelligence.

Nothing from Mrs. Clinton has surfaced. But that does not mean they were not stolen, only that they have not been made public." (And again, emphasis is mine.)

Well, speaking for myself only, I for one would like to know how my bong ended up in the bottom drawer of Mr. Sanger's desk at the New York Times' Washington bureau.

These fools for scandal make my head hurt.

mind blowing. Arguing that the lack of evidence is proof is through the looking glass thinking.

As I said earlier, I thought Comey's statement about "possible" hacking was BS.

I will do my own reading between the lines and following of the logic, there exists a super hacker out there, undetectable by the best minds of the FBI and it's all Hillary's fault of course.
Following Comey's logic there are ZERO servers in the world that can be declared secure.

    It's pretty funny too (5.00 / 1) (#116)
by Militarytracy on Thu Jul 07, 2016 at 08:04:04 AM EST
When we hold that logic up to the fact that we know that Russia was in our classified info and has all of the information on everyone who held a security clearance at the time of the breach. What is contained in that information? EVERYTHING! All of that person's family members and their contact and employment information, all of their important life events, possibly anyone they have a relationship with outside of the U.S. We know those databases have been breached. It's right out of 'The Americans'.

I guess it must be annoying to discover that Clinton's homemade server was more secure than our most classified databases.

    BEIJING--
China has admitted for the first time that a massive hacking attack on U.S. government databases was carried out by Chinese hackers, but denies it was a state-backed operation. Chinese state media say the incident was among several others discussed during high-level cyber security talks in Washington this week.

The revelation was mentioned almost in passing in a Xinhua state media report this week on the talks. The report did not provide any other details about the hackers or if they have been arrested.

"Through investigation, the case turned out to be a criminal case rather than a state-sponsored cyber attack as the U.S. side has previously suspected," the report says.

how far this is carried.  Certainly, the matter here related only to HRC as SOS & associates & the State Dept, in general. Beyond that intense situation, tho, the reality may not be as precise.

Whether it is right & proper or not, the longstanding inter-agency tension as to method & style of classification may well be found to reveal a mish-mash in extensive reality.  Director Comey hues strictly to all things ... as his personal style and position would dictate that he should.  Do not be surprised that if and when these issues come up in a broader location, setting that many "t"s have not been crossed nor "I"s dotted. The ripples in this stream have a real potential to be very far-reaching.

FYI, Louisiana is a conceal-carry state, so even if Alton Sterling did have a gun, those officers had no way of ascertaining whether it was in his possession illegally before shooting him at point-blank range and killing him. Further, the video evidence (from two different sources) and the statements of the store owner, who witnessed the confrontation in its entirety and recorded it with his cell phone, clearly do not support your contention.

FOIA avoidance, that was always known
despite Madame Sec's claims for convenience,
which Director Comey just blew out of the water.

Comey stated there will be no criminal charges,
But je left open that there could be other consequences, If she were anyone else, Comey said in a televised press statement, the facts uncovered in the FBI's investigation might cost Clinton her security clearance -- if not her job.

"To be clear, this is not to suggest that in similar circumstances, a person who engaged in this activity would face no consequences," Comey said. "To the contrary, those individuals are often subject to security or administrative sanctions. But that is not what we are deciding now."

FOIA avoidance, that was always known

    is that fact or speculation?

FOIA avoidance was certainly an effect that arose from Hillary's use of a private server, & from the destruction of some 30K e-mails "deemed" personal, but are you confusing that effect with the cause of the private server's use (that is, the reason or reasons for using it)?

maybe you see Occam's razor where Comey saw Hanlon's razor

i didn't understand Comey's statement as leaving open the possibility of other consequences for what he characterized as extreme carelessness

i understood him to be saying that security/administative sanctions would have been likely if the subject of the investigation had been anyone other than the former SoS & current presumptive Democratic presidential nominee

without Comey's clarification of the "number of factors" that he cited as relevant to a decision about whether to bring charges, that presents a very troubling appearance, at least to my eyes, & i voted for Hillary in two presidential primaries

i'm personally relieved by the outcome of the FBI's investigation, but at the moment i'm not proud of feeling that way

Am convinced it was for FOIA evasion (not avoidance, evasion)
Keeping all the emails from the State Dept for years, official federal records, until the State Dept sheepishly requests Madame Sec to comply with law and give them her e mails as SOS.
The vast quantity deleted, the process used to determine business from personal. The fact that official federal records (e  mails) were found by the FBI, that were never turned over to the State Dept.
The State Dept is in lockstep with Madame Sec, they do have the e mails of her aides, Abedin, Mills, and others that have been requested for FOIA.
the State Department is asking a federal judge to extend the deadline to complete processing of the records by more than two years.
Justice Department lawyers notified U.S. District Court Judge Rudolph Contreras on Wednesday that State will be unable to meet the court-ordered deadline of July 21 in the lawsuit the conservative group Citizens United brought earlier this year seeking emails ex-State Department officials Cheryl Mills, Huma Abedin, Melanne Verveer and Michael Fuchs exchanged with individuals at the Clinton Foundation or a firm with ties to the Clintons, Teneo Consulting.

All this to postpone the inevitable release of these e mails, until after the election, well into the "Madame Presidents 1st term, and hopefully the furor will have died down.

And finally the blatant , in your face, perpetually told lies to the american public and the media for over the past year, and now, her refusal to address these blatant lies to anyone. In speech, in a statement, god forbid she actually talk to reporters.

we will go from the "most transparent ever" administration of Barack Obama (lol, the press has found that statement laughable) to the second coming of a Nixon Administration.
Yes, ole Tricky Dick had to walk away because of a 18 minute gap in a tape, well there are 30,000 emails missing.
And inquiring minds are looking at that also
    http://tinyurl.com/jmakgbh

But, when it comes to Clinton's correspondence, the most basic and troubling questions still remain unanswered: Why are there gaps in Clinton's email history? Did she or her team delete emails that she should have made public?

But a numeric analysis of the emails that have been made public, focusing on conspicuous lapses in email activity, raises troubling concerns that Clinton or her team might have deleted a number of work-related emails.

We already know that the trove of Clinton's work-related emails is incomplete. In his comments on Tuesday, Comey declared, "The FBI ... discovered several thousand work-related e-mails that were not in the group of 30,000 that were returned by Secretary Clinton to State in 2014." We also already know that some of those work-related emails could be permanently deleted. Indeed, according to Comey, "It is also likely that there are other work-related e-mails that [Clinton and her team] did not produce to State and that we did not find elsewhere, and that are now gone because they deleted all emails they did not return to State, and the lawyers cleaned their devices in such a way as to preclude complete forensic recovery."
Why does this matter? Because Clinton signed documents declaring she had turned over all of her work-related emails. We now know that is not true

I will stick with Occam's Razor

Sorry, not with Madame Sec, that will not fly, although she is using it as her reason.

Facts, no, there is no fact yet available to confirm what Madame Sec's intent was.

Just her intent desire to keep the private ...private.

That part was confirmed in a e mail with Abedin, and her response (Abedin's) rang a little false.

Yes, Occam's razor seems the more appropriate avenue for thought, especially considering the subject.

My only point was it seemed to me Comey was going out of his way to put the worst possible spin/most negative on a lot of the information he delivered in his statement.

I really don't care anymore, nothing I've seen in this ridiculous witch hunt shows that she was acting in bad faith.

I don't believe there has ever been a prior cabinet secretary who has had to release the entirety of their daily work emails.  Most of what have been release wouldn't even meet the definition of Federal Records.  The OIG report made clear in multiple places that only certain emails should be preserved.  She turned over 1000's of boxes of them.

... in place at the time did not preclude her from doing so. Given her previous public comments on the subject, in which she stated that she found it more convenient to keep her existing email account, which was already on the Clinton Foundation server, rather than use a State Dept. email address, it's apparent that Mrs. Clinton is not very tech-savvy personally.

She clearly didn't understand that one can have two email accounts on the same device, because she said that she didn't want personal, non-work-related government emails from family and friends to fall under the government domain and thus be subject to outside scrutiny. Further, she preferred using her BlackBerry because she was familiar with it, and really didn't want to learn a new device.

(Ironically, since the FBI subsequently took custody of the Clinton Foundation server, her private emails are now likely in government hands, anyway. So rather than preclude that from happening, she inadvertently ensured by her own decision making that it would happen.)

Mrs. Clinton has since admitted publicly that she exercised poor judgment in arriving at that decision, and obviously wouldn't do it again. Like the Benghazi nothingburger from which it devolved, this has been an incredibly overblown issue. And now that Attorney Gen. Loretta Lynch has officially closed the DOJ's books on this matter, I'm going to move on, too.

    How did we get here?

i think it's because the GOP learned the wrong lessons from the 2012 primaries & decided to have many more debates this year, with far too many candidates who got just enough support in early polling & primaries to make The Donald's support look more robust than it really was

& because portions of the GOP base (like portions of the Democratic base) have been caught up this year in a wave of populist anger & chose to give the (short vulgarian) finger to the party bosses who spent millions of dollars trying to shove Jeb! down their throats

& because The Donald, as the party bosses should have expected, is intensely media-savvy (at least with respect to our sh!tty media), notwithstanding the fact that he's an ignoramus

That the author of the piece points to the loss of power by the political class as a primary driver of this "chaos" but waits until the second to last sentence to suggest that maybe they are partly (I would argue mostly) responsible for the descent. The Tea Party would have fizzled out of existence if the mainstream GOP political class didn't rush to bring them into the fold and then hand them the keys to their party. The mainstream parties are responsible for gerrymandering that gives the crazies safe districts that let them act out their Tea Party fantasies without fear of losing a seat.

What we are seeing is a failure of the political class (and also the media). And the reason is that much like many other organizations that initially start well intentioned, its own continued existence becomes the primary focus of its efforts. Mainstream politicians, organizations etc care more about staying in business then about fighting for whatever policy goals they were originally created to further. The media created Trump because it is good for business, not necessarily good for the furtherance of any objective truth/reporting.

Also they believed that Hillary would not be the nominee and even those that believed she might be the nominee think that she's an awful candidate easily beatable. Of course all of this thinking is never questioned in the right wing bubble world.

BRZEZINSKI: No I'll tell you what you saw.

    SCARBOROUGH: What did you see?

BRZEZINSKI: You saw him connecting with the crowd in a way that no other politician in the history of politics that we know ever could. You can't imagine a Republican candidate going up there and talking about his golf course in Turnberry without getting killed. Remember the car elevator and all sorts of things that plagued Mitt Romney? This guy talks about his Turnberry golf course and everybody in the audience is with him, about the construction project, and about his son and they actually feel they could own a golf course in Turnberry. He connects. He connects.

Gowdy walked through intent, that there is no one outstanding statement where a defendant comes out and says I intend to commit this crime.
Prosecutors use circumstantial evidence to prove intent, like having a unauthorized private server in ones basement, retaining these federal documents offsite for 2 years, with no intention of returning them to the state department until the State department requested them back.
