A Minnesota judge has issued a temporary restraining order against the Department of Homeland Security prohibiting it from destroying evidence pertaining to the killing of Alex Pretti.

U.S. District Court Judge Eric Tostrud granted a temporary restraining order against the U.S. Department of Homeland Security Saturday, barring the department from altering or destroying evidence connected to Pretti's killing.

How about a restraining order banning ICE from conducting enforcement operations in Minnesota?

The Wall St. Journal (free link here) says the videos don't support the claims of law enforcement. I'm not surprised, are you?

    Here is the initial DHS statement on Alex Pretti's killing:

    Minneapolis, MN

    At 9:05 AM CT, as DHS law enforcement officers were conducting a targeted operation in Minneapolis against an illegal alien wanted for violent assault, an individual approached US Border Patrol officers with a 9 mm semi-automatic handgun, seen here.

    The officers attempted to disarm the suspect but the armed suspect violently resisted. More details on the armed struggle are forthcoming.

    Fearing for his life and the lives and safety of fellow officers, an agent fired defensive shots. Medics on scene immediately delivered medical aid to the subject but was pronounced dead at the scene.

    The suspect also had 2 magazines and no ID--this looks like a situation where an individual wanted to do maximum damage and massacre law enforcement.

    About 200 rioters arrived at the scene and began to obstruct and assault law enforcement on the scene, crowd control measures were deployed for the safety of the public and law enforcement.

    This situation is evolving, and more information is forthcoming.

    ... aka Gauleiter Barbie, DHS has become a wholly unreliable and consistently disingenuous narrator of events such as Saturday morning's tragedy. The word choice "approached with a 9mm" is evidence of a clear intent to mislead the reader into thinking the victim, Alex Pretti, was brandishing a firearm as he approached U.S. Border Patrol agents.

    In fact, the gun was holstered. Mr. Pretti had a valid license to carry, and per the videos released to the public, he was filming federal activities with his cell phone. Federal agents approached Pretti and another woman and instigated the confrontation. One violently pushed the woman to the ground and then pepper-sprayed Pretti, who was swarmed by agents and taken to the ground.

    At one point, one of the agents unholstered Pretti's 9mm and removed it, but as he turned and spun away from the pile-on, the gun appears to have gone off. The other agents fired nine times into the victim, likely killing him instantly.

    At the minimum, what we witness on these videos is, at a minimum, felony assault and manslaughter. The was no legal justification for arresting and detaining the victim and yet, he was pepper-sprayed and gang-tackled in egregious violation of his rights under both the First and Second Amendments, and then he was killed after he had been disarmed.

    Thank heavens for cell phone videos.

    been sprayed with pepper spray, no less directly in the face, I am not sure... but I bet MOST would resist violently.

    they refer to the protester/victim as the "suspect".
