Happy Mother's Day

What are your plans this Mother's Day? I'm going to sleep in, and in the afternoon, the TL kid and I are going to see "Girl With the Dragon Tattoo."

I'm sorry I've been too busy to blog all week. It's not just things popping in all my cases. I also have a new associate, and for a committed solo practitioner like me, it's a pretty big deal. But what better day to announce it than Mother's Day -- since my new associate is none other than the TL Kid. Who would have thought he'd get there from here?

For all our readers who are mothers, have a great day. And for those of you who are not, I remember how great it feels to get a phone call that begins, "Hi, Mom" when your kid is far away. So don't forget to call.

    Many of us are lucky enough not just to have our kids around for a day of fun, food and laughs, but to have our own mothers around, too; for those of you whose mothers are no longer with us, I know your thoughts will turn to your moms today, too - and they should.  Just because they are no longer in this world, they are still in your heart, and are so much of who you all are today.

    For the moms who may have lost children, I know your hearts ache a little more today, for what was lost, for the futures your children never got to enjoy; know that I'm thinking of you today.

    For those who whose desire to have children has been a struggle and not been fulfilled, there's something about the wanting to have kids that starts to transform you into a mother, so I know there is an ache inside you today that is a little deeper.  Know that I hope your dreams of motherhood come true.

    This is one of those days when I feel so blessed: happy healthy kids, and a happy and relatively healthy mother of my own; I know it won't always be this way, so I cherish not just the official celebration, but every day we have together - once those days are gone, we can't get them back.

    Happy day to all, and to you, Jeralyn, congrats on the new addition to the practice!  All success and happiness to you both.

    to send thoughts of thanks to all of the surrogate mothers -- aunts, friends, and more -- who have been so important in my children's lives, too.

    It really does take a village to raise a child.

    One kid graduated from college (5.00 / 1) (#10)

    and married, so happily, since last Mother's Day -- and not the one I would have imagined marrying first, much less finding me such a marvelous daughter-in-law from halfway around the world who has brought so much more into our lives as they lived with us for half the year. And now they are on their own, struggling but so determined to be independent as best they can in this economy . . . so still letting us help here and there.

    The other kid back in college since last Mother's Day and, yay!, on Dean's List again -- after years before of struggling through school with her disabilities . . . so now she is back in school to be a teacher, the sort of good teacher she had sometimes (and not the other sort, from whom she also learned, sadly, how not to be).

    One of the stepkids just married at 45, for the first time, and also is so happy at last -- deservedly so, as one of the alltime nice guys who finished last in love for so long but now is getting his rewards for staying nice all these years until a wise woman noticed.

    The other stepkid still looking for work, too, but also in a committed relationship that brings him joy -- as do the latest marvels of medical technology that are helping him hear for the first time in years.

    Yes, most still are unemployed or underemployed, and they will struggle for years to overcome the setbacks of this year's economy -- and they won't be lawyers or in other more promising careers than teaching with all of the layoffs now or construction with the downturn now, etc.  And all of this has cost us a fortune in travel and immigration fees and tuition and housing and feeding and hearing aids and more. . . .

    But this is when we know that it really is just money, and that money can't buy us or them love -- but it can help them and us to find love and happiness in the darndest places and pursuits that bring us happiness in seeing them grow into fine people who bring us friendship on an adult level, offering intellectual challenges with new ideas and more, as well as love always.

    What a year!  I know your coming year ahead of discovery of so much about your child's mind also will be as interesting and rewarding, Jeralyn.  Beyond that, who knows?  Parenting is one of those gifts that keeps on giving, but it's also like one of those mystery gift packages full of surprises.  

    And I have still more surprises coming, as the one of mine who isn't with us today called to say that the other will be bringing her present -- something she made along with her elementary ed students when helping them how to make Mother's Day presents.  I had to say, oh no, one of those weird presents that you made at that age, all odd and lopsided that I had to pretend to admire and still have saved all these years?  Yep, she said -- and you're going to love it, lopsided and all, because I made it for you with love.  So now I have this hankering to haul out the box of Weird Artwork of Decades, bring back the memories -- and make room for more.

    busy, detailed practice which seems to be almost 24/7 I remember why I never wanted to be a solo practicioner.  But now you will have an associate.  And such a choice.  Congratulations to you both.

    I have nothing against mothers -- I have a wonderful one myself, who is soon to turn 87 if the Force stays with her, and have been married over 35 years to another -- but something else is also on my mind.  Why was there such a to-do last week about Faisal Shahzad's "Miranda rights" and not a peep about the fact that, despite having been arrested on Tuesday, May 4, and charged that day in formal criminal complaint filed in federal court, he has yet to be presented before a U.S. Magistrate Judge to be offered (or denied) bail and appointed counsel?  Rule 5(a)(1)(A) of the Federal Rules of Criminal Procedure requires this to occur, following arrest, "without unnecessary delay."  The Supreme Court confirmed just a couple of years ago in the Corley case that delay exceeding six hours for the purpose of interrogation -- not to mention the current five or six days -- is automatically considered "unnecessary."  As a result nothing Shahzad has told the FBI (or whomever) in the last week can be used against him in a criminal case, not matter how "voluntary" or well-warned.  What's up, I wonder?  This situation is extremely unusual.  Anyone have thoughts?

    The article oculus links to, and which I remember reading, suggests that Shahzad did see a "short list" council, so that he could waive his rights knowingly.

    Not sure why that is not public, as oculus asks.

    in such cases, speculating about what may have happened.  I don't know that that qualifies as the article author's suggesting that it did happen.  Nor that an extra-legal process under which the investigators and prosecutor handpick the lawyer for the arrested person is valid under the Sixth Amendment or otherwise lawful.

    That is why I am surprised that it has to be speculated on, and is not public.

    Because we have been down this road before, not that the mindset of these guys necessarily changes instantly with a new administration and president committed to removing "the stain" of BushCo.. It would seem that it is in their interest to do things correctly so that they do not have to contaminate their case.

    they got the FPD's office out to advise him when they were ready to mirandize him (after he talked the first time and they determined there was no ticking time bomb and the emergency exception to Miranda no longer applied) and he said he wanted to keep cooperating. In high profile serious cases here, the FPD gets notified after the arrest rather than the usual procedure which is at the first court appearance. The FPD may have agreed to waive the right to an immediate appearance. (It's not like he was going to get bond.)

    Just speculation on my part, and I don't know how they do it in NY, but I've seen the FPD get involved before the first court appearance here.

    is at least as plausible, and a lot less disturbing, that the speculation of the Business Week reporter linked by Oculus at #20.  The Federal Public Defenders for EDNY/SDNY are excellent attorneys, knowledgeable and sophisticated, devoted to their clients' best interests, and not tools of the prosecution.

    Mothers' Day (second Sunday in May - US) hasn't fallen on the same weekend/day as the Fishing Opener in MN (falls on the weekend two weeks before Memorial Day)

    When it DOES fall on the same weekend...oh watch out...unless Mom is a fisher-person too.

    I find this conflict/dilemma funny, interesting and a culturally screwy part of life around here.

    HERSH: To use a basketball or a football analogy, American football, fourth quarter - he may have a game plan. At this point he's in real trouble. Because the military are dominating him on the important issues of the world: Iraq, Iran, Afghan and Pakistan. And he's following the policies of Bush and Cheney almost to a fare-thee-well. He talks differently. And he's much brighter, he's much more of the world.     I had read the second book and am halfway through the first. The TL Kid hadn't read any, and he really liked it too. I think it helps if you know the history of Lisbeth -- she was perfectly cast. I'm really excited for the third book which has been out in Europe for months and being released here in a few weeks.
