Grand Junction Proposes 12 Month Moratorium on Medical Marijuana Dispensaries
Grand Junction, in Mesa County, Colorado, is considering this ordinance banning new medical marijuana dispensaries for 12 months. It provides penalties -- anyone who holds themselves out as a primary caregiver for the purpose of acquiring, possessing, producing or transporting medical marijuana or paraphernalia, without having a sales tax license is committing a misdemeanor. No new sales tax licenses will be granted for 12 months. Businesses with existing sales tax licenses cannot add medical marijuana to their inventory.[More...]
It quotes the state's Attorney General and police chief's opinions that dispensaries will lead to greater crime. What does the police chief base this on? Two burglaries at a single dispensary. And, quite troubling, it requests that if the state enacts regulations, it be granted the right, as a Home Rule community, to enact stronger restrictions. More here.
This morning, a hearing will be held in Denver District Court challenging last week's amendment to the definition of primary caregiver by the State Board of Health at a hastily convened meeting.
The Colorado Bar Association is holding a continuing legal education program at lunchtime on Weds. on medical marijuana -- presented by defense attorneys.
