With the start of primary season, the amount of time spent blogging, live-blogging, number-crunching, researching, graphics hunting and more has really escalated.

On top of that, it's moving week for me -- always a dreaded experience both in terms of cost and anxiety.

    Blackwater has sued its former lawyers (among them present WH counsel Fred Fielding, et als.) for alleged legal malpractice in failing to get removed from state to federal court the wrongful death suit by the families of the four "contractors" killed, torched, beheaded and hung from a bridge in Iraq back in 2004.  

    "Removal" is a means by which a civil case filed in state court can be transferred at the defendant's behest to federal court, if the federal court has subject matter jurisdiction.  It's usually done when the defendant feels they can fare better in federal court, most likely when there is a federal statute (creating federal question jurisdiction) that gives some advantage to the defense.  For example, it used to happen a lot in ERISA cases, where someone sued their HMO for relief beyond getting another copy of the "plan" book.

    Blackwater may have reason to regret this move.  When a client sues their lawyer for malpractice, this allows the lawyer to disclose confidences the client gave, to the extent necessary to effect a defense.  This is one of the exceptions to the overall Rule of confidentiality of client confidences.  So, for example, if the convicted criminal defendant sues his lawyer for malpractice, the lawyer can defend the suit by saying (in so many words) "I committed no malpractice;  he's guilty.  He told me so."  Assuming that's true, of course.

    One is compelled to wonder what, if anything, Blackwater told their attorneys....

    It is amazing that the press claims innocence. Clinton got it right they were baiting him with a sexist remark, that Hillary can not win on her own, she needs a man.

    Bill took the bait with nasty repartee. Too bad he did not just address the sexist remark.

    What does it say about Barack Obama that it takes two of you to beat him?

    What does it say about the press' sexism.
