Schumer Calls for Alberto Gonzales to Step Down

Sen. Charles Schumer called on Attorney General Alberto Gonzales to step down today. Sen. Joe Biden hedged his bets and said it's Bush's call but it wouldn't be a bad idea.

I doubt it will happen. He's too entrenched. Then again, it wasn't that long ago that Harriet Miers, another of Bush's long-time, loyal counsel, didn't get confirmed to the Supreme Court.

I think rather than having Gonzales step down now, we should concentrate on electing a Democrat as President in 2008, so that we hopefully can get a less ideological Attorney General in 2009.

However bad Gonzales may be, he's no John Ashcroft. It was Ashcroft, not Gonzales' Justice Department that brought us the Patriot Act, pushed Patriot Act II, the Feeney Amendment, created guidelines for attorney-client monitoring of conversations, demanded the DEA raid medical marijuana clinics in states that had legalized medical use of the substance, and so on and so on.

Gonzales hasn't had that much of an effect on the day to day workings of the criminal justice system, so far as I can tell -- at least not in my cases. The main restrictions we face are those created by Ashcroft -- and Congress' continued willingness to enact mandatory minimum sentences.

There's lots of blame to go around.

Update: If you feel differently, you can join in Big Tent Democrat's series on why Gonzales should be impeached. Philosophically, I agree. As a practical matter, I'd rather invest my time in seeing a Democrat get elected.

    I know that some persons on this board have become caught up in such things as the scooter libby trial, inhumane care at Walter Reed, the surge in an unnecessary war, Katrina's botched rescue, torture of prisoners, foolish firings of US attorneys and other such things.

    However, it seems to me that you all are forgetting about the Administration's effort to combat sex slavery in Eastern Europe.  And, if you haven't been to ABC news recently, this weekend they are reminding you of this great program.  

    It seems to me, that, since the Administration is doing at least one good thing--a thing which many of us had somehow forgotten or not been aware of--
    and since Gonzales is part of the Administration, that, therefore, he should stay as AG!

    I think that philosophically and practically I am good to go with a Gonzales impeachment, but I have to second your reference to Ashcroft, Jeralyn.

    Torture memos were drafted and implemented on his watch.  Larry Thomspon signed off an sending Maher Arar to torture in Syria on his watch.  Comey came up with one of the first "state secret" intervention programs in the Arar case to conceal the role of DOJ in Arar's torture.  The doctrines of "illegal enemy combatants" as having no rights to be free from abuse and the ability to disappear civilians and ghost detainees and turning over American Citizens in Justice's custody to military abuse, etc. etc. etc.

    I keep hearing people say Gonzales makes Ashcroft look good and I have to wonder where they were during Ashcroft's destruction of DOJ?

    Impeach Gonzales and arrest Ashcroft.
