Jose Padilla's Motion to Dismiss

The Southern District of Florida Blog details Jose Padilla's Motion to Dismiss for Outrageous Government Conduct. It's well-worth reading for Padilla's factual recitation of what was done to him during his three years of confinement. I especially like the introduction:

"Whoever fights monsters should see to it that in the process he does not become a monster. And when you look long into an abyss, the abyss also looks into you."

Friedrich Nietzsche, Beyond Good and Evil 89 (Walter Kaufmann trans., Vintage Books 1966) (1886).\

Legal reporter Vanessa Blum covers the motion here.\

Update: The motion itself is here.

As much as I should be appalled by the government's conduct, I'm not surprised. They lifted the whole book from the NKVD. And, going back to my earlier comments about thugs being promoted while decent people, like Commander Swift, get tossed out of the service, here's a link to this spring's Navy promotion list, to the rank of Captain. Towards the middle of this alphabetical list is the name of Padilla's jailer through these atrocities - Catherine Hanft. CPinVa, JimakaPPJ - you seem awfully quiet about this....

A day later, and in these precincts there still are only crickets chirping from the directions of CPinVa and Jimakappj.... What gives, folks? Afraid to comment on this? Unwilling to face what the policies you pitch really mean? Come on! Say something!
