Kansas Prosecutor Intimidates Witness

Kenneth Junious was the only eyewitness who (supposedly) placed Surgio Johnson at the scene of Melvin Jackson Jr.'s murder. That made Junious a vital witness. When Junious expressed reservations about testifying, prosecutor Barry Disney crossed a line:

The judge said Disney made a false threat of criminal charges and additional jail time to coerce Junious into testifying.

That attempt to coerce a witness prompted Sedgwick County District Judge David Kaufman to exclude Junious' testimony. The district attorney's office appealed the ruling, but its appellate office abandoned the appeal, undoubtedly concluding that it was fighting a losing battle. Perhaps the DA's office worried that an appellate court might ask unpleasant questions about its failiure to charge one of its own with intimidating a witness.

Chief Deputy District Attorney Kim Parker said the office would decide whether to proceed to trial or drop the charges against Johnson after the Court of Appeals releases the case back to Sedgwick County District Court.

    This is just unbelievable! How long was this up? Nobody commented on this? This reminds me of a recent article in Time about Baltimore Prosecutors Jailing Witnesses in same Jails as the Defendants they're gonna have to testify against. We're talkin' inner-city, hardcore, gang-related, drug dealers violent felons story lines right out of HBO's "The Wire" so real you expect Stringer Bell and McNulty to step out of the alley any second.

    Charge someone who works for the government with a crime? Come on, thats so 20th century.

    Since I live in Sedgwick County (Wichita), Kansas, home of Dennis Rader aka BTK, here are a few thoughts from the front lines. The Kim Parker referred to above, along with DA Nola Foulston, have had three or four major cases overturned by the Kansas Supreme Court for things like misleading the jury during closing arguments. I'm not a lawyer, don't have all the specific details, but I testified in the trial of Sakone Donesay (murder, he killed a police officer) and had to testify again in the retrial, so I know that one was overturned. I think the Michael Marsh death penalty case was also overturned. At any rate, this DAs office is one of those that will do anything necessary to getr a conviction, although being Wichita, KS hasn't received alot of national media attention. It wouls be informative for someone with legal training and resources to look a little deeper into this office. Where the hell is Wichita, KS, anyway?

    I guess that doesn't include doing everything necessary to KEEP a conviction
