Federal Judge Orders Release of Names of Gitmo Detainees

U.S. District Court Judge Jed Rakoff, one of my favorites (for many reasons, including this one) has ordered the Pentagon to release the names of the Guantanamo detainees.

U.S. District Judge Jed S. Rakoff told the government to provide the information in the form of unredacted copies of transcripts and documents related to 558 military hearings in which detainees were permitted to challenge their incarcerations.

AP attorney David A. Schulz said he expected the government to appeal. "The judge has rejected the Defense Department's effort to use the privacy interests of detainees to prevent the public from learning information about the actions taken at Guantanamo Bay," he said.

    Wait...these prisoners have no federal legal rights whatsoever (Graham/Levin Amendment), but suddenly they've got a right to privacy??? WTF?

    This administration is worried about the "privacy interests of detainees" like it's worried about Bigfoot. Is there anyone who wouldn't just laugh at it. Sure, in case somebody in their might be, ahem, innocent, we wouldn't want their good name out there being slandered.

    We routinely release the name of civilian detainees, and the administration released the names of Padilla and Al-Marri kept in U.S. brigs. It has been years, and the notion that foreign militaries might not know about the detentions in ludicrous. Also, there is an independent public right to have trial be public in the absence of a compelling interest to the contrary, and the names of prisoners of war are routinely turned over to their national government. The secrecy is simply a play to hide American wrongdoing.

    Also, notably, because this is a FOIA case brought by U.S. persons, it isn't impacted by the Detainee Act, even though it relates to Guantanamo.
