FISA Warrants Increased Steadily Since 9/11

News organizations are reporting that FISA surveillance was up again in 2004, and that the Court did not rubber stamp all requests, but asked the Bush Administration to modify several.

In 2002, there were 1238 FISA warrants issued, up from 934 in 2001. All requests were granted in both years. In 2003, the number jumped to 1727, and in 2004, to 1758. A full chart is available here.

In 2003, the FISA Court rejected 4 and modified 79 of the Government's requests for warrants. In 2004, the Court modified 94 of the applications. None were denied, but three were withdrawn by the Government before the FISA court acted on it.

    in 1999 1/886 requests was modified 2000 1/1005 request were modified 2001 2/932 requests were modified 2002 2/1228 were approved as modified, were appealed, and reinstated without the modifications 2003 4/1727 denied, substantive changes made to 79 requests 2004 94/1778 requests were modified by the court. So is this the "problem" Bush cited. Can't get all through without some questions being asked. The number requiring modification strikes me as not striking so why the problem?

    Bad wording at the end. point is the number requiring modification was only 5%.

    Everybody knows the FISA courts are little more than a rubber stamp...how bogus the warrants that were denied must have been?

    I hear that dadler. I'd bet the victims of the taps lacking any oversight weren't enemies of the state at all...just enemies of the GOP or the status quo. These people viciously slandered one of their own, J. McCain, to gain power. You think they will think twice of illegally spying on their political foes?

    According to the Washington Post, one official stated that "For FISA, they [NSA] had to put down a written justification for the wiretap....They couldn't dream one up." Ironically, just five years ago the director of the NSA told Congress that it must be strictly regulated by FISA. I guess NSA just tells Congress whatever lies it can get away with until the NYT blows their cover.
