Report: Libby Seeking New Lawyer

The Washington Post reports Scooter Libby is shopping for a new lawyer. That's not surprising, and I don't mean that as a poor reflection on Joseph Tate.

Joseph Tate is not primarily a trial lawyer. This happens frequently after Indictments. Tom DeLay added Dick DeGuerin, one of the country's best trial lawyers, after it became clear he was going to get indicted.

Here are my recomendations to Mr. Libby and anyone else in indicted by Fitzgerald:

After indictments come down, those fighting the charges will need the most skilled criminal defense lawyers out there. Trial lawyers. Lawyers who have battled the Government every day for years.

The corps of available top-notch Washington criminal defense lawyers may be seriously low. First of all, they tend to work in big firms. Firms that represented anyone in this investigation are conflicted from having a partner represent anyone else.

Case in point: David Kendall of Williams and Connolly would be an excellent choice. But, he's partners with Terrence O'Donnell who represented Dick Cheney when he talked to Fitzgerald. So unless Cheney is one of those indicted, Kendall is out of the game.

    I had hoped... sigh. Things sure turned out different. But in a study of human history we see that we've always been this way: at each other's throats.

    TL, Surely there are some lawyers out there who are not celebrities who are up to the job. Roy Black was a public defender in Miami for 5 years. How many people got him for free on DUIs and such? Why not give Big Tex a shot? He's elequent, and can write. How about John W. Hall? I find it hard to believe that only celebrities can defend this case, some of them spend more time on TV than in the courtroom!

    Those are my picks and I'm sticking by them. His tv stuff has nothing to do with it. Having worked with Roy, and all the lawyers in his office, I know how great they are. You also need a lawyer with a substantial amount of media savvy in a case like this.
