Clemency Urged for Lovitt

Ken Starr was unsuccessful in his effort to persuade the Supreme Court to review the conviction and death sentence imposed on Robin Lovitt (TalkLeft background here). Among other reasons to review the case: initial DNA tests were inconclusive, but a court clerk destroyed all the evidence after Lovitt was sentenced, making additional testing impossible.

Under the circumstances, this editorial sensibly argues that Lovitt should not be executed:

Virginia officials now want to schedule Lovitt's execution for Nov. 30. But after sending Earl Washington Jr. to death row for a rape and murder he did not commit, the commonwealth has an even greater responsibility to make sure its own procedures are flawless before it puts anyone to death. Supreme Court or not, deliberate destruction of evidence falls far short of any reasonable threshhold.

Gov. Mark Warner, who so far has not commuted any of the 11 death sentences carried out on his watch, should sign the clemency order this time.

    Yeah, well Virginia loves to execute. Slightly OT, if the OR death with dignity law is a violation of the 1971 Controlled Substances Act (as currently being argued in the SCOTUS), why is lethal injection not also a misuse of drugs by a "doctor"? I'm sure there is some perfectly legal loophole the death-loving right wing legal types can come up with here, eh?

    Now is the time to be magnanimous and stand with Kenn Starr on this issue... however forlorn the hope might be.

    Ken Starr is behind this? Wow! Maybe the man has a heart, afterall. Life never ceases to amaze me. And, of course, Lovitt deserves clemency.

    Ken Starr has been actively assisting in capital cases in recent years. He has also been inspirational in getting other well heeled lawyers to do so. I am not asking why, just that a belief that even the lowest of the low deserve representation is a belief shared by many. When we talk about building bridges to reach our goals I think we often forget that many of our goals (such as equal justice) are shared by many on the religious right. The sides may never agree on such issues as abortion and gay rights, but we have too much in common on other issues dealing with race, class, & social justice not to work together where we can find common ground.

    Some may contribute a more dubious motive to Ken Star and that is, the preservation of the Death Sentence itself! I think Star knows the DS is in grave trouble and is becoming more and more un-popular. I have come to really distrust this man. He is slick and ruthless and lacking moral fiber. Then again he may be trying to buy his way into heaven.
