Inexcusable Pandering by Jeb Bush

by TChris

Regular participants in and observers of trials soon learn that most witnesses, no matter how well intentioned, are poor estimators of times and distances. It's no surprise that Michael Schiavo gave varying estimates during interviews in 1992 and 2003 of the time at which he discovered his wife's collapse.

If he looked at his watch and two days later could recall exactly what it said, I'd be mildly surprised. So to think it highly suspicious that he got the time wrong or rounded it off too roughly two years after the fact, and again 13 years after the fact, is laughable.

Michael Schiavo has been consistent as to the critical point: he called 911 promptly after determining that his wife was unresponsive. As TalkLeft recently noted, Jeb Bush nonetheless wants the state attorney in Pinellas to investigate Jeb's unsupported suspicion that Michael waited half an hour before calling for help.

Jeb's continued pandering to the religious right while attempting to save face by hounding Michael Schiavo is inexcusable. Schiavo has endured enough tragedy without being forced to defend himself against Jeb Bush's scandalous attempt to assassinate his character. An autopsy (and a review of medical records) revealed no evidence to support the slanderous assertions of abuse leveled by Terri's parents, and there is no credible evidence that Michael waited (or had any reason to wait) before calling for help.

Jeb Bush's abuse of the criminal justice system to pursue the religious right's vendetta against Michael Schiavo is appalling. Michael deserves an apology.

As opposed to the excusable pandering . . . .

Just to spell this out a little more explicitly, Chris, for those in the TL community who aren't criminal lawyers .... The DA's office can only investigate reasonable suspicions of criminal conduct. The statute of limitations for any crime that could possibly have been committed 12 years ago has surely expired -- except for murder. So what Gov. Bush is saying is that the DA should proceed on the theory that Michael Schiavo murdered his wife, intentionally causing her serious injuries from which she eventually died. (I assume, without looking it up, that Florida has repealed the common law year-and-a-day rule that formerly cut off all such cases from even being considered murder if the victim lingered that long.) Let's not mince words here; that's what Bush is suggesting, and the only thing he could be suggesting. Which takes "pandering" to a new level of personal cruelty, imho.

Peter, The "year and a day rule" is long gone in Florida.

Michael Schaivo is the "deviant" that the christian fascists go after first, along with gays. It's Sunday. I can feel the throngs of sheeple flocking to their alters to hear the latest religious shepherds feed them their weekly ration of "Revelations". Of course, Orange County, CA is only a few miles north.

While nothing M Schiavo did was illegal, I believe Fl Stat 509 P1 does name 'pandering' as a crime;-)

Jeb, Delay, and Frist just can't stand the words "I told you so".

Meanwhile, an intern died in a Florida government office, and the case was never properly investigated. Apparently, she banged her head. Perhaps they can disinter the body in 50 years and go after the felons who killed her. Because justice never sleeps, except with the rich. Did you hear that Jeb has deputized OJ Simpson to look for the true killer of Terri Schiavo?

On the bright side, this should all but sink Jeb's presidential hopes. I would hope sensible Republicans would be as sickened by this vendetta as the rest of us.

Ah, yes, here it is: ""FORT WALTON BEACH, FL. - Lori Klausutis, a 28-year-old office worker for Rep. Joe Scarborough (R-Fl), was found dead in the congressman's district office. Police said preliminary findings from the medical examiner's office showed no foul play or any outward indication of suicide." "Unbelievably, that was it. The story was simply dropped. A young female employee of one of Florida's Congressmen had died unexpectedly in the Congressman's office. There were no witnesses to her death and the cause of death was not apparent. Klausutis' boss, Joe Scarborough had recently resigned from Congress prematurely and unexpectedly..." Lori Klausutis
