Kobe Bryant's Hearing: Will it Go Forward?

Bump and Update: Fox News reports that the hearing will go forward and the defense plans on calling witnesses to attack the accuser's credibility. We'll try to post updates throughout the day. If you're not into Kobe news, just scroll past this.

Kobe Bryant has arrived at the Eagle County courthouse for his court hearing scheduled to begin at 3 pm ET but whether it goes forward remians unclear.

Will it go forward? Hard to say. Up until yesterday, we were pretty sure the Judge's recent rulings that the accuser did not have to be present or testify and refusing to close the courtroom to the public would result in a waiver of the hearing. Now, it's anybody's guess.

Dan Abrams reported last night on MSNBC that Kobe's lawyers want to call a witness at the hearing but the prosecution is objecting. The only prosecution witness revealed so far is the police officer who interviewed the accuser. The prosecution intends to use this witness to relate what the accuser reported about the incident, and to introduce photographs of the accuser that have been reported to show some kind of bruising. It will also try to introduce the statements of a nurse who examined the accuser as to what the injuries depicted in the photos mean through the testimony of the officer.

We don't know who the defense wants to call. Perhaps it's an expert to contest the prosecution version of what the photographs mean. Perhaps its someone to whom the accuser told a different story than the one contained in the police report. If the Judge decides the defense may call their witness, the hearing is likely to go forward. On the other hand, if the request is denied and if the Judge refuses to close portions of the hearing that will reveal irrelevant and overly prejudicial information-- or if the judge decides to allow the photographs to be made public during the hearing without allowing the defense the opportunity to present independent testimony on their meaning-- perhaps they will waive it.

Either way, it's already a media circus up in Eagle. We're working here in Denver, but will be discussing the case tonight on MSNBC's Abrams Report (9 pm ET, repeats at 1am).
