Lots of things are considered to be morally wrong but do not violate a specific law.  An open statement about "lawlessness" would invite more countries indicting Rumsfeld, etc.  Those of you who are gleefully awaiting this need to remember that similar abuses happened under the LBJ and FDR war regimes, and I doubt that you would have wanted the French to indict them.
